Terms & Conditions of Hire Definitions
The Hirer is the person for whom the booking is made.
The Lessor is the owner of the Black Shed – Mrs Blair Hunter Davies.
The Letting or Holiday is the period for which The Black Shed is booked.
Your Stay
Bookings are weekly and run from Saturday to Saturday.
Check-in is from 4pm on day of arrival.
Check-out is by 10am on day of departure.
The Black Shed provides accommodation for 2 people. With prior agreement this may be extended to 4 people in total. Due to the nature of the open plan building and wood burning stove the Black Shed is not suitable accommodation for children under the age of ten.
The first supplies of fuel for the wood burning stove are included. For any further supplies a small charge will apply. Guidance for using the stove will be provided.
Organic cotton Bed linen, feather filled duvet and pillows for the main bedroom are provided as well as towels. The kitchen is equipped with tea towels. All linen is provided on a weekly basis.
Electricity & Hot water are included in the price.
Our water is from the natural spring on our land and is subject to regular obligatory water quality testing by the authorities.
There is no landline telephone at the property or terrestrial Television. Some mobile reception is available and in emergencies there is a landline telephone in the Lessors house next door. There is a TV, DVD player, wireless internet connection and Apple TV in the Black Shed for use during your stay.
THE BLACK SHED IS STRICTLY NON SMOKING
General
The Black Shed accepts no responsibility for loss, injury or damage to any member of the Hirer’s party or their property, arising in any manner out of the let of the premises, however caused.
The Hirer undertakes to leave the hired premises secure if left unoccupied during the period of let. With the changeable weather conditions on Skye it is necessary to ensure the windows and doors are always shut securely when not in the building.
The Hirer shall not sub-let the premises or any part thereof.
The Hirer shall undertake to prevent any member of his party from causing a nuisance or disturbance to neighbouring residents or occupiers.
The Hirer undertakes to relieve the Lessor from any liability for damage or injury by any member of his party, however caused.
The Hirer warrants that the subjects let are to be used for the purposes of a Holiday. Accordingly, Section 12(2) and Paragraphs of Schedule 4 of the Housing (Scotland) Act 1988 applies to the letting to the Hirer.
We reserve the right of entry to the property at all reasonable times for the purposes of inspection or to carry out repairs or maintenance.
The Hirer binds and obliges himself to vacate the hired premises without demand at the termination of the period of hire.
We reserve the right to demand immediate departure of any holiday maker not complying with the booking conditions, or for any conduct detrimental to the property.
Payment
A non-refundable deposit of 25% is required to confirm and secure your booking within 48 hours of any provisional booking that may be made.
The balance is due 8 weeks before the holiday / letting start date.
If the balance of the payment is not received by the due date the Lessor may treat the booking as cancelled.
Bookings made less than 8 weeks prior to the letting require the payment in full.
We accept payment by BACS transfer.
Cancellations
Once you have confirmed your booking for The Black Shed, our agreement with you is a legal contract and you are liable for the whole cost of the holiday. Therefore we strongly recommend that you take out holiday cancellation protection. In any event, should you cancel your holiday with us we will attempt to re-let The Black Shed, and if successful we will make a full refund to you, less an administration charge of £50. Therefore, please let us know as soon as possible if you wish to cancel.
The Hirer agrees that, in the event of Cancellation, while all reasonable efforts will be made by the Lessor to re-let, the Hirer will be responsible for paying for the period of tenancy booked if a substitute cannot be found.
If for any reason beyond our control the Black Shed becomes unavailable for hire all monies paid will be fully refunded and the Hirers will have no further claim against the Lessors.
Good Housekeeping Deposit
The Hirer shall ensure that the property is left in a clean and tidy condition and that the property and its contents are respected at all times. If damage occurs (beyond fair wear and tear) or excessive cleaning is required then a claim may be made on the good housekeeping deposit provided. The Hirer binds and obliges himself to pay the lessor in respect of any loss or damage beyond fair wear and tear.
Please leave the property clean and in a state in which you would like to be welcomed with.
A good housekeeping deposit of £50 is required 8 weeks prior to the letting date and payable by cheque which will be returned to you at the end of your stay.
Pets
Sorry, no pets are allowed as this is a working croft and we have our own animals.
Also some of our guests have allergies and in light of that the Black Shed is pet free.
Acceptance
By making an email or telephone booking with a deposit or payment by BACS, cheque or otherwise, you are deemed to have accepted these booking conditions and you must ensure that all members of your party understand and comply with these terms.
